Article 2 – Applicability

These terms and conditions apply to every offer by Mad Monk Jewelry and to every distance contract concluded between Mad Monk Jewelry and the consumer. The text of these terms is made available before the contract is concluded and can be consulted from every page of the website.

Article 3 – The offer

The offer contains a complete and accurate description of the products offered. All prices stated include VAT. Obvious mistakes or errors in the offer do not bind Mad Monk Jewelry. Gemstones are natural products; colour and pattern may vary slightly from the product photos.

Article 4 – The contract

The contract is concluded when the consumer accepts the offer and meets the corresponding conditions. Mad Monk Jewelry confirms receipt of the order by email.

Article 5 – Right of withdrawal

The consumer may cancel a contract for the purchase of a product without giving reasons during a cooling-off period of 14 days after receipt, and notify us of the return shipment.

After notifying us of the return, the consumer has 14 days to send the product back. After notification of the return, Mad Monk Jewelry has 14 days to refund the full order amount (including shipping costs), provided the product has been received back or the consumer can show proof of shipment. Only the direct costs of the return shipment are borne by the consumer.

Depreciation: during the cooling-off period the consumer will handle the product and packaging with care and will only use the product to the extent necessary to assess its nature and characteristics – as would be allowed in a shop. Depreciation resulting from use beyond this may be charged to the consumer.

Exclusion of the right of withdrawal: the right of withdrawal does not apply to products manufactured according to the consumer's specifications (custom-made), such as bracelets made especially for the consumer based on a specified wrist size and personal choice of stones. This is clearly stated before the contract is concluded. As a courtesy, Mad Monk Jewelry offers a resizing service for custom bracelets: resizing costs € 10 to € 15, depending on the design, plus shipping costs.

Article 6 – Price and payment

All prices include VAT. Any additional costs, such as shipping costs, are clearly stated before the contract is concluded. The consumer can pay using the payment methods offered on the website.

Article 7 – Delivery and performance

Mad Monk Jewelry will process orders promptly and deliver within 30 days at the latest, unless a different delivery period has been agreed. In the event of a delay, the consumer will be informed and has the right to dissolve the contract free of charge. The risk of damage or loss of products rests with Mad Monk Jewelry until the moment of delivery to the consumer.

Article 8 – Conformity and warranty

Mad Monk Jewelry guarantees that the products comply with the contract, the specifications stated in the offer and reasonable requirements of soundness and usability. The statutory warranty applies in full.

Article 9 – Complaints and disputes

Complaints about the performance of the contract can be reported via Happytohelp@madmonkjewelry.com. Complaints are answered within 14 days of receipt. If this does not lead to a solution, the dispute can be submitted for mediation via WebwinkelKeur: webwinkelkeur.nl/kennisbank/consumenten/geschil.

Contracts between Mad Monk Jewelry and the consumer are governed exclusively by Dutch law.
